By accessing or using Warrantedecatalo services, you agree to be bound by these Terms of Use. These terms govern your access to and use of our video editing, animation, and visual effects services provided through warrantedecatalo.ddd. If you do not agree to these terms, you must not use our services.

We reserve the right to modify these terms at any time. Your continued use of our services after changes are posted constitutes acceptance of the updated terms. These terms were last updated on December 20, 2024.

Our services are provided for video editing, animation, and visual effects projects. You agree to use our services in compliance with applicable laws and not for any unlawful purposes. You must be at least 18 years old to use our services.

Permitted Use

You may use our services only for lawful purposes and in accordance with these Terms of Use. You agree to use our services in a manner that does not infringe upon the rights of others or violate any applicable laws or regulations.

Prohibited Activities

You agree not to engage in any of the following prohibited activities:

• Violating any applicable local, state, national, or international law or regulation
• Transmitting any material that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
• Infringing upon intellectual property rights, including copyrights, trademarks, or patents
• Transmitting viruses, malware, or any other malicious code
• Attempting to gain unauthorized access to our systems, networks, or accounts
• Interfering with or disrupting the operation of our services or servers
• Using automated systems to access our services without permission
• Impersonating any person or entity or misrepresenting your affiliation with any person or entity
• Collecting or harvesting information about other users without their consent
• Using our services to compete with us or to build a similar service
• Reverse engineering, decompiling, or disassembling any part of our services

Violations

Violation of these acceptable use provisions may result in immediate termination of your access to our services, legal action, and reporting to appropriate law enforcement authorities. We reserve the right to investigate violations and cooperate with law enforcement.

Service Provided As-Is

Warrantedecatalo provides services "as-is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

Limitation of Damages

To the maximum extent permitted by law, Warrantedecatalo and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of or inability to use our services.

Total Liability Cap

Our total liability to you for all claims arising from or related to our services shall not exceed the amount you paid to us in the twelve months preceding the claim, or one hundred dollars ($100), whichever is greater.

Exceptions

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for incidental or consequential damages. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.

Informal Resolution

We encourage you to contact us first to resolve any disputes informally. Please contact us at admin@warrantedecatalo.world or call +14086139507 to discuss your concerns. We will make good faith efforts to resolve disputes within 30 days.

Mediation

If informal resolution is unsuccessful, you agree to attempt to resolve the dispute through mediation before initiating arbitration or litigation. Mediation shall be conducted by a mutually agreed-upon mediator in accordance with the rules of the American Arbitration Association or similar organization.

Binding Arbitration

If mediation is unsuccessful, any dispute, controversy, or claim arising out of or relating to these Terms of Use or our services shall be resolved through binding arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules. The arbitration shall be conducted in Long Beach, California, United States.

The arbitrator's decision shall be final and binding. Judgment on the arbitration award may be entered in any court having jurisdiction. You waive your right to a jury trial and to participate in class actions.

Exceptions to Arbitration

Notwithstanding the above, either party may bring claims for injunctive relief or other equitable remedies in any court of competent jurisdiction. Additionally, disputes involving intellectual property rights may be brought in any court of competent jurisdiction.

Governing Law

These Terms of Use shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

Jurisdiction

For any disputes not subject to arbitration, you agree to submit to the exclusive jurisdiction of the state and federal courts located in Los Angeles County, California, United States. You waive any objection to venue in such courts.

International Users

If you access our services from outside the United States, you are responsible for compliance with local laws. These Terms of Use are governed by California law regardless of your location.

We reserve the right to terminate or suspend your access to our services immediately, without prior notice or liability, for any reason, including breach of these Terms of Use. Upon termination, your right to use our services will cease immediately.
